Supreme Court victory for the Firm on the cadastral classification of toll stations.
The Firm, with a team composed of Giuseppe Pizzonia and Laura Trimarchi, successfully assisted an highway company in a dispute before the Supreme Court concerning the correct classification in the cadaster of toll stations.
The Supreme Court, upholding the company’s defenses, ruled that the area used as a highway toll station must be classified as E/1, as it lacks functional and income autonomy, regardless of the concessionaire’s status as a corporation. In particular, the above-mentioned area represents a constituent element of the highway network and is therefore uncommerciable property necessarily intended for public service and instrumental to it.
