Firm provides assistance for MAP between Italy and Belgium that confirms multinational group’s TP
The Firm’s team, composed of partners Cristiano Caumont Caimi and Simone Zucchetti, senior associate Michele Bissoli, and associate Griselda Lishi, as a result of the “Mutual Agreement Procedure” initiated between Italy and Belgium pursuant to the Arbitration Convention, has obtained confirmation of the transfer pricing policy adopted by a multinational group active in the production and distribution of technical and medical gases.
The competent authorities of the two Member States have agreed that the adjustment made by the Italian Revenue Agency in relation to the prices applied to the sales of gas between the Italian parent company and the Belgian “subsidiary” of the group was unfounded, thus accepting, both in terms of method and value, the arguments put forward by the Firm in the request to open the MAP.
