Patent Box: Firm advises on three advance agreements relating to fashion and publishing sectors.
During the months of June and July 2018, Tremonti Romagnoli Piccardi e Associati advised some leading fashion and publishing operators on the signing of three advance agreements for the purposes of benefitting from the Patent Box regime. This brings to five the total number of agreements that have been signed to date with the Firm’s assistance.
In further detail, the activities carried out by the Firm involved, firstly, the filing of the requests for the advance tax rulings, this was followed by assistance during the preliminary hearings and formal discussions – that lasted approximately 18 months – with the competent offices of the Italian Revenue Agency (specifically, the Regional Directorates of Lombardy and Veneto) during the course of which the methods and criteria to determine the income eligible for the tax relief were defined and implemented in the final agreements.
The aforementioned agreements were particularly notable, depending on the specific case, for the amount of tax benefit involved, the peculiarity of the sector concerned, the type of intangible asset that was claiming relief – also in connection with the kind of right to use the aforementioned asset – as well as the complexity of the relevant hearings.
The proceedings which led to the signing of the agreements saw the involvement, on behalf of the companies, of dedicated teams. The Firm’s team was composed of partners Fabrizio Colombo, Cristiano Caumont Caimi and Simone Zucchetti, and associates Michele Bissoli, Giulio Tombesi, Ira Shiku and Niccolò Masotti.
