Victory for the Firm in Banco BPM appeal
The Firm’s team, composed of partner Cristiano Caumont Caimi and senior associate Maria Vittoria Moioli, successfully defended Banco BPM before the Regional Tax Court of Turin.
The dispute arose in relation to certain Irpeg (tax on the income of legal persons) and Ilor (local income tax) credits, amounting to tens of millions of euro, which the (then) Banca Popolare di Novara had requested to be refunded in 1995, and with respect to which, the Revenue Agency, only in 2014, issued an order of refusal for lack of evidence concerning the credits in question.
The judges of the Turin court, in their ruling delivered on 15 November 2017, upholding the decision obtained in the court of first instance by the abovementioned lawyers, ordered the Agency to refund the credits in full, both on the grounds of the untimeliness of the refusal and the merit of the refunds requested.
